COBRA is a federal requirement for most employers with 20 or more employees and allows employees, retirees, spouses, and dependent children the right to continue their employer sponsored health coverage at group rates after experiencing certain qualifying events where the coverage would otherwise end.

The Consolidated Omnibus Budget Reconciliation Act (COBRA) legislation was enacted in 1985 to provide continuation of group health coverage as a result of the concern of individuals losing their group health coverage due to a variety of circumstances, causing the loss of benefits. Almost all group health plans of private and public employers with 20 or more employees employed on a typical business day must comply with COBRA. Employers must count all employees to determine if they are eligible for COBRA, not just those who are covered under the employer’s group health plan.
